Kongregate provides tools and infrastructure to help developers distribute and monetize games. When you upload a game, you agree to the Game License & Upload Agreement and the Data Processing Addendum (DPA).

What You Keep Ownership Of
When you publish a game on Kongregate, you always retain ownership of:
your game
source code
artwork and assets
trademarks and branding
intellectual property rights
Uploading a game does not transfer ownership to Kongregate.
Instead, you grant Kongregate a license to host and operate the game on the platform.

What Kongregate Is Allowed To Do
To operate the platform, Kongregate may:
host and distribute your game
promote it to players
integrate it with Kongregate services
make technical changes needed for platform compatibility
Kongregate cannot materially change your gameplay or monetization systems without your approval, except where required for legal compliance or core platform functionality.

Revenue and Monetization
Developers can earn revenue through Revenue Share Programs.
Examples may include:
advertising monetization
platform APIs
multiplayer services
marketplace features
blockchain or digital asset integrations
Each program defines its own revenue share rate, (also known as a royalty) which may vary depending on the services used.

Game Stability and Support
Developers are responsible for maintaining a playable and stable game.
If a critical issue affects players (for example crashes or broken purchases), developers are expected to resolve the issue within the Time to Resolution (TTR) window.
Revenue share deductions may apply if major issues persist for extended periods, but safeguards exist to prevent excessive penalties.

Content Rules
Games must follow Kongregate’s Content Standards, which prohibit things like:
illegal or infringing content
malware or malicious software
deceptive monetization
abusive or harmful material
These standards help ensure the platform is safe for players and developers.

AI and Machine Learning
Developers may use AI tools when creating games, provided they have the legal rights to the content produced.
Kongregate may use aggregated gameplay data to improve:

recommendation systems

Blockchain and Digital Assets
Games may include NFTs or blockchain-based assets, but developers are responsible for ensuring:

Kongregate provides the platform infrastructure but does not control external blockchain networks.

Privacy and Player Data
Both Kongregate and developers share responsibility for protecting player data.

Leaving the Platform
Developers can remove their game from Kongregate according to the agreement.
Once removed:
the platform license ends
Kongregate stops distributing the game
final payment reconciliation may occur.
