Kongregate offers multiple Revenue Share Programs that allow developers to monetize their games using platform services and infrastructure. Each Revenue Share Program provides different tools, integrations, and services. Because these services may vary in complexity and operational cost, the developer revenue share percentage varies by program. Program criteria may require a game to be updated to support specific Kongregate technology to be eligible.
The following describes the terms that apply to ALL Revenue Share Programs, while the specific terms of a Program will be described in the relevant Program details.
1. Scope
These Revenue Share Program General Terms apply to any opt-in monetization or revenue-sharing program made available by Kongregate (each, a “Program”).
Each Program may include Program-Specific Terms that define:
- criteria that a game and/or developer must meet to be eligible for the Program
- revenue share percentages
- eligible revenue sources
- additional requirements
In the event of a conflict:
- Program-Specific Terms control for that Program only
- otherwise, these General Terms apply
2. Relationship to the Game License & Upload Agreement
All Programs are governed by the Game License & Upload Agreement.
These terms supplement (but do not replace) the Agreement.
3. Net Revenue (Program-Specific Application)
Unless otherwise specified in a Program:
“Net Revenue” means amounts actually received by Kongregate from monetization of a Game, less applicable deductions, which may include:
refunds, chargebacks, and reversals
payment processing fees
third-party platform or distribution fees
taxes (including VAT, sales tax, or similar)
advertising network fees and revenue shares
mediation or mediation platform fees
fraud, bad debt, or invalid traffic adjustments
other third-party costs directly attributable to generating that revenue
Each Program may further specify or limit applicable deductions.
4. Payments
- Payments are made periodically (see PAYMENT | How and when are developers paid?).
- Subject to:
- minimum thresholds
- tax withholding
- valid tax documentation
5. Taxes and Withholding
Developers are responsible for their own taxes (see PAYMENT | Taxes and Withholding).
Kongregate may:
- apply withholding as required by law
- rely on submitted tax information to determine rates
6. Platform Control
Kongregate retains control over:
- monetization systems
- pricing and formats
- third-party partners (e.g., ad networks, payment providers)
7. Changes
Kongregate may update Programs with notice via the Developer Portal.
8. No Guarantee
No Program guarantees revenue, performance, or inclusion.
9. Compliance with Program Requirements
Developers must meet all eligibility requirements and ongoing obligations applicable to each Program.
If Kongregate determines, acting reasonably, that a Game does not meet the applicable eligibility criteria for a Program, Kongregate may provide notice to the developer and, where reasonably practicable, an opportunity to cure the issue within a specified period. If the issue is not cured within that period, or if the issue is not reasonably capable of cure, Kongregate may treat the Game as having not been eligible to participate in the Program for the affected period. In such circumstances, Kongregate may withhold, offset, or recover any amounts previously paid in connection with that Program, in accordance with the Game License & Upload Agreement.
